Jumboo’s Terms of service

Welcome to Jumboo !

This document constitutes a legally binding contract between you (the “User“) and JUMBOO (“Jumboo”, “we”, “our”) governing access and usage of the mobile App, websites and any associated feature or API (collectively, “the service“).

0. Key definitions

  • User content: any data submitted, displayed or generated by the User, including auto-generated content (ie. by AI).
  • Minor: any person that didn’t reach legal majority according to the legislation in their country of residence or citizenship (ie. less than 18 years old in the EU, less than 21 in some US states for specific features).
  • Protected characteristics: personal information covered by anti-discrimination laws, including but limited to: race, origin, religion, sexual orientation, gender identity, handicap, serious diseases, caste, migrant status, age (separately or in combination with another characteristic).
  • Strictly forbidden content: any post or content pertaining to categories listed in 3.1 of the present TOS.
  • Competent authorities: judicial, administrative, or regulatory authorities habilitated to formulate binding requests according to applicable law, including:
    • In Europe: CNIL, national judicial authorities, European Commission, DSA (Digital Service Act) coordination authorities, local authorities via TCO (Team Coordinated Orders).
    • In the US: FTC, DOJ, FCC, NCMEC, and any competent jurisdiction according to DMCA, COPPA, FOSTA-SESTA, or any relevant legislation.
    • Rest of the world: judicial authorities, regulators and forces acting in compliance with applicable law (DSA, GDPR, TCO, DMCA, COPPA, etc.).

1. Agreement

By installing, accessing or using the Service, you recognise having read, understood and agreed to the TOS as well as the Privacy policy. If you do not agree to any of the terms, you must cease using the Service.

2. Ethical founding principles

2.1 Reasonable freedom of expression

We encourage debate and creativity, but freedom of speech ends with endangerment of others (hate speech, harassment, disinformation leading to physical or democratic risk).

2.2 Authenticity

Only one profile per person; misleading identities, purchase of interactions or unauthorized bot usage are forbidden.

2.3 Security

Zero tolerance for violence, minors exploitation, human trafficking, terrorism, malware or financial fraud.

2.4 Privacy

Compliance with GDPR (EU), CCPA/COPPA (US); encryption in transit and at rest; conservation of connection logs for 13 months except as otherwise provided by law.

2.5 Dignity and non-discrimination

Any degrading, de-humanizing or exclusion-inciting (towards an individual or a group) based on protected characteristics is forbidden.

3. Content policy

3.1 Strictly forbidden content (immediate deletion)

  • Hate speech and incitement to violence.
  • Organizations or individuals labeled as terrorists, extremists or criminals.
  • Sexual exploitation, including any unwanted or suggested representation, no matter the age of the people involved.
  • Explicit nudity, including for advertisement or entertainment purposes.
  • Extreme violence, explicit calls to murder or suicide, broadcasting live violence.
  • Financial fraud, identity theft, malware, hacking guides.
  • Serious breaches of privacy: doxxing, medical data, non-public official documents.
  • Promotion or sale of illegal or regulated goods or services, including but not limited to:
    • illegal drugs or non-medical use of regulated substances;
    • cannabis or nicotine based products, alcoholic beverages;
    • firearms, explosives, ammunition, weapons accessories;
  • money games services or illegal gambling;
  • training or coaching services without verifiable certification, notably about health, finances and wellness;
  • unapproved tax-exemption or tax optimization services;
  • acts of animal cruelty, promotion of violent shows involving animals or cruel content.

3.2 Regulated content (restricted public / warnings)

Are considered “regulated content” those which, although not being subject to immediate interdiction, can hurt the sensitivity of certain audiences, require an adapted access framework, or present a risk of misinterpretation. This includes, but is not limited to:

  • Non sexual nudity with artistic, medical or educational purposes, with a clear context, not suggestive and without promotional purpose;
  • Discussions about suicide, self-harm or eating disorders in an awareness-raising, support or prevention framework;
  • Documentation of violent events (wars, catastrophes, human rights violations) with an informational or witnessing purpose, without glorification or unfiltered shocking images.

This content can feature a preliminary warning, an age filter, an auto-blur or partial de-indexation according to each case. Their repeated reporting or misappropriation can requalify them as forbidden content: with a warning screen, age-filtered and, in some cases, de-indexed from public results.

3.3 Content requiring human review

Due to their complex, ambiguous or socio-political nature, some contents will require advanced human review before being posted, restricted or deleted. This category includes, but is not limited to:

  • Strong impact manipulated or doctored media such as deepfakes or doctored audiovisual montages involving public figures, institutions or voting events, especially when they can alter democratic integrity or be detrimental to the common good;
  • Indirect threats, whether humorous or coded, including in meme and emoji form, cultural misappropriation or ambivalent quotations, susceptible to be interpreted as bullying or hate mongering;
  • Posts relating to elections, sanitary campaigns or public health susceptible to containing misinformation, conspiracy theories or unsubstantiated claims presenting as scientific or official;
  • Other borderline cases reported by the community, notably in case of doubts on the author’s true intention, virality risk or probability of misappropriation of the initial content.

These materials are always reviewed by human moderators, supported by independent experts if needed. Content can be maintained but with a warning, partially concealed, or deleted according to the team’s review.

4. Moderation and sanctions

4.1 Reporting and handling

Users can report any suspicious, inappropriate or illegal content via integrated tools. Each report is reviewed by our moderation team without delay. In case of established breach, we apply proportionate measures: content deletion, warnings, temporary suspension, permanent deletion of the account.

4.2 Proportionate sanctions

  • Warning: formal notification to the user about the breach nature and reminder of the rules.
  • Temporary suspension: deny access to the Service for a fixed period of time, ranging from 24 hours to 30 days according to the seriousness of the offense.
  • Permanent deletion: closing of the account and content deletion without any possibility of recovery.
  • Reporting to the authorities: in case of serious illegal activities, competent authorities can be alerted in compliance with current regulations.

5. Cooperation with authorities

JUMBOO fully cooperates with competent authorities while respecting legal procedures and the users’ fundamental rights. Requests for information or content removal will be assessed on a case-by-case basis, checking their legality and proportionality. We will inform involved users to the extent permitted by law.

6. Personal data protection

6.1 Collection and use

We collect the necessary data to bring, maintain and improve the Service, including but not limited to: account information, posted content, connection data, preferences, and interactions. This data is used to:

  • Offer features the users ask for.
  • Guarantee security and prevent fraud.
  • Customize user experience and content suggestions.
  • Communicate with users (notifications, updates, support).
  • Respect laws and regulations.

Data is not sold to third-party advertisers, and any international transfer has to adhere to clauses from the GDPR.

6.3 User Rights

In compliance to current laws, you have the following rights in regards to your personal data :

  • Right to access, edit and erase.
  • Right to limitation of processing and opposition.
  • Right to data portability.
  • Right to withhold consent at any time.
  • Right to file a complaint with the competent control authority.

7. Account deletion and data access

7.1 Account deletion: you can delete your account at any time via the settings. Deletion is effective within 24 hours. Your data is erased with a maximum delay of 30 days, except legal constraints.
7.2 Access request: you can ask for a complete report on your data via datareport@jumboo.io. The report is sent to you within 30 days through secured channels.

8. Intellectual property

Every element of the platform (texts, images, logos, algorithms, etc.) are protected by intellectual property laws. Any unauthorized use is forbidden and may be subject to legal action.

9. Protection of minors

The use of Jumboo is reserved for persons aged 13 and over. Users under 16 have increased restrictions (private profile, alerts to authorities in case of danger).

10. Liability and guarantees

Jumboo offers its services without explicit guarantees. We disclaim any liability for indirect damages related to use. Users are responsible for the content they post and their use of the Service.

11. TOS updates

Any update will come with a notification at least 15 days prior to its effective date. Continued use of the Service implies acceptance of the new TOS. Version history is available on Helpcenter.jumboo.io/legals.

12. Applicable law and jurisdiction

Applicable law depends on the user’s country of residence:

  • European Union: French law, Paris courts unless otherwise required by law.
  • United States: Texas law, Austin courts.
  • Other jurisdictions: local law, in compliance with international standards.

To strengthen our commitment to an ethical and secure use of the Service, Jumboo works with leading organizations such as: e-Enfance, Respect Zone, Point de Contact, Common Sense Media, NetSmartz (NCMEC), ConnectSafely, and the Cyber Civil Rights Initiative (CCRI).

Our Terms of Service are based on major international legal norms, including:

  • General Data Protection Regulation (GDPR – EU Regulation 2016/679)
  • Digital Services Act (DSA – EU Regulation 2022/2065)
  • Children’s Online Privacy Protection Act (COPPA – 15 U.S. Code § 6501-6506)
